Acting pursuant to Rule 870(5) the committee determined that RARANGI JEWEL be relegated to fourth placing.

The placings now read:

1st  No. 14  Miss Middleton
2nd No. 12  Door Slammer
3rd  No. 8    Innes Boyz
4th  No. 10  Rarangi Jewel

The committee ordered that dividends and prize money be paid in accordance with the amended placings.

Facts:

Following the running of Race 1 (The Matt and Marion Hickey Handicap Trot) Information No. A2333 was filed with the judicial committee instigating a protest. The Information alleged that RARANGI JEWEL broke over the final 40m and was lapped on by DOOR SLAMMER (P Ferguson) and INNES BOYZ (M Hickey).

Rule 870(5) states:

“Notwithstanding the provisions of sub-rule 4 hereof any horse which is not in its gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the judicial committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman then subject to Rule 869a such relegation of the horse shall be at the discretion of the judicial committee”.

The Judge’s placings were:

1st  No. 14   Miss Middleton
2nd No. 10   Rarangi Jewel
3rd  No. 12   Door Slammer
4th  No. 8     Innes Boyz

The margins were:

2L, long neck, long neck.

Submissions for Decision:

Stipendiary Steward Mr Mulcay showed all relevant films and said that RARANGI JEWEL broke its gait with 40m to travel and was still in a gallop at the winning post in spite of its driver doing all he could to return the horse to the trotting gait. He added that at the winning post the third and fourth place getters had lapped on, hence the protest.

Mr D Butcher representing the connections of RARANGI JEWEL said that he agreed with Mr Mulcay’s interpretation of events in that RARANGI JEWEL had galloped over the line and that the two other horses had lapped on.

Reasons for Decision:

After considering all of the evidence the committee was satisfied that RARANGI JEWEL had gone from a trotting gait to a galloping gait with approximately 40m to travel and that it was still in a gallop on reaching the winning post and that the third and fourth place getters (DOOR SLAMMER and INNES BOYZ) respectively) had lapped on.
