The Committee decided that “Sunlaw” should be relegated to 4th and the amended placings are now:-
1st – Number 8 – Kristine Winz
2nd – Number 9 – Flashman
3rd – Number 7 - Imatrotnovsky
4th – Number 10 – Sunlaw
5th – Number 11 – Dux
 
Payment of the amended dividends was duly authorised.

Facts:

Following the running of race 3, information 11829 instigating a protest was filed by Chief Stipendiary Steward Mr N Escott under rule 870(5) – the lapped on rule. The information stated the protest was against horse no. 10 “Sunlaw” placed 2nd by the judge.
 
Rule 870 (5) states:-
“Notwithstanding the provisions of sub-rule(4) hereof any horse which is not in its correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of the interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee”.
 
“Lapped on” means when a horse has its nose in line with any part of the breaking horse’s body when the nose of the breaking horse reaches the finishing line.
 
The official placings in the race were:-
 1st – Number 8 – Kristine Winz
2nd – Number 10 – Sunlaw
3rd – Number 9 - Flashman
4th – Number 7 – Imatrotnovsky
5th – Number 11 – Dux
 
The official margins in the race were a head, ½ head and ¾ length

 

Submissions for Decision:

Mr Escott asked Mr Taumanu to show the side-on view of the film. Mr Taumanu identified “Sunlaw” and said that 3-4 strides short of the finishing line “Sunlaw” had broken from it correct gait and was still in its incorrect gait when it reached the finishing line. At that time it was lapped on by the 3rd placed horse “Flashman” and the 4th placed horse “Imatrotnovsky”. Photographic evidence of the finish of the race was also provided to the Committee. Mr Taumanu submitted that “Sunlaw” should be relegated behind both “Flashman” and “Imatrotnovsky” as “Sunlaw” had been lapped on by both horses.

 

Reasons for Decision:

The Committee has viewed the films of the last 100m of the race and also the photographic evidence provided by the Stipendiary Stewards. The Committee is satisfied “Sunlaw” should be relegated behind both “Flashman” and “Imatrotnovsky” as “Sunlaw” was lapped on by both horses.
