Facts:
Mr. S. Dickson admitted a breach of rule 869 (2) (a) in that he used his whip excessively when driving the horse ‘Broke’ over the concluding stages.
Mr. Renault, using the films available, submitted that ‘Broke’ was racing about 2 lengths of the eventual winner and was struck approximately 21 times on the run to the line. He informed the committee that anything over 20 strikes constitutes a charge. Mr. Dickson confirming his admittance of the breach submitted that his horse was battling and he thought he had a chance to run 3rd or 4th. ‘Broke’ finished towards the tail of the field.

Mr. Renault informed the committee that Mr. Dickson has had 21 drives this season. He drives mainly in the Manawatu and Cambridge areas, and he has no breaches under this rule. He submitted that the breach would be classed at the lower end of the scale and while an option to suspend for this offence did exist in the JCA’s guidelines he felt a fine of between $200 and $250 would be appropriate on this occasion.
Mr. Dickson submitted that he was happy for either a suspension or a fine and did confirm he had not been charged under this rule in the last 12 months.

Mr. Dickson, in arriving at our decision to impose a fine for this breach, we have taken into account your admittance and your record. The committee was aware that a period of suspension could be imposed under the JCA guidelines. We felt however your relative small number of drives and the limited venues you drive limits the capacity to impose a suspension.
