Following the running of race 3, the Dream Away at Woodland Mobile Pace, Ms N Chilcott the driver of LADY BESS was charged with breach of rule 869 (3)(b). It was alleged that Ms Chilcott drove carelessly
Following the running of race 3, the Dream Away at Woodland Mobile Pace, Ms N Chilcott the driver of LADY BESS was charged with breach of rule 869 (3)(b).
--It was alleged that Ms Chilcott drove carelessly causing interference to her own horse when she attempted to hold a position outside ALIVE IN NEW YORK (PC Ferguson), who was improving on her inside with approx 500m to run.
--At the commencement of the hearing the registrar advised that Ms Chilcott had admitted the breach however had elected not to attend the hearing.

PENALTY
--Prior to making his penalty submission Mr Taumanu demonstrated the breach by way of the films of the race. These showed LADY BESS break and lose its chance at about the 500m mark, and it was clear from the films that Ms Chilcott was not in a position to react to Mr Ferguson in the way that she did.
--With regard to penalty Mr Taumanu submitted that a moderate fine was appropriate. There were obviously no submissions from Ms Chilcott.
--In determining penalty the committee finds that the appropriate penalty, in this case, is the imposition of a fine and that such fine should be $250.00
--This penalty being consistent with other penalties imposed for similar breaches of this rule.
--The committee further orders, under the provision of Rule 1114 (2A), that 50% of the fine be paid to the connections of LADY BESS.
--Of significance is that this meeting of the Manawatu HRC Club is only a one day meeting and LADY BESS has travelled a considerable distance to be here. The interference suffered by LADY BESS was not of its own doing but rather its chances were eliminated by the actions of its driver.
--It is also relevant that no other runner's chances were affected in the incident complained of.
