Alledged breach of rule 869 (3) (b).
Facts:
Mr V Blanchard admitted a breach of rule 869 (3) (b) in that as the horseman of Major Day he drove carelessly.
Submissions for Decision:
The available films were shown again (these were used in information hearing 13980). Both Mr Taumanu and Mr Blanchard had nothing further to add.
Reasons for Decision:
The films clearly showed the movement of Major Day causing interference to horses behind.
Submissions for Penalty:
Mr Taumanu confirmed Mr Blanchard had not been charged under this rule before. He asked for consistency in setting the penalty as horses behind were affected and may have cost at least one from running into a stake bearing position. He asked for a penalty of suspension.
Both Mr Blanchard senior and junior had no problems with Mr Taumanu’s comments.

Mr Blanchard incoming to our decision to impose a period of suspension for this breach we have taken into account your admittance and your record under this rule. However, your actions did result in your drive being disqualified because of the interference caused by your horse to at least three others.
This we believe must be answered by a term of suspension.
