Facts:
Following the running of Race 2 (Stoney Creek Mobile Pace) Information No. A10272 was filed with the Judicial Committee. It was alleged by the informant that Mr Heaton drove carelessly when contacting a wheel of the sulky of WAINGARO MARA with approximately 250m to travel.
Mr Heaton said that he understood the Rule, the charge and confirmed that he admitted the breach.
Mr Muirhead said that the film replays showed that when being driven forward CONTRACTUAL ISSUES struck a wheel of WAINGARO MARA’s sulky near the 250m. As a consequence the tyre was punctured and WAINGARO MARA was forced to race with the flat tyre from that point.
Mr Heaton said that he had admitted the breach and had nothing further to add.
Submissions for Penalty:
Mr Muirhead said that Mr Heaton had a good record under the Rule and that a fine was usually imposed by the JCA for such a breach of the Rule. However he advised the Committee that Mr Heaton had suggested to him prior to the hearing proper that a suspension would be a preferable penalty as he had been fined for another breach of the Rules in the same race.
Mr Heaton in response said that he was a hobby trainer/driver and would prefer a suspension as opposed to receiving another fine. Mr Heaton advised the Committee that he was driving at Rangiora on Sunday next and that his next drives following that day would be at Nelson on 9 June and Marlborough on 23 June 2019.

Under all the circumstances the request for a suspension was deemed reasonable by the Committee. It was determined that a 2-day suspension was an appropriate penalty.
