--Following the running of race 6 K Webber was charged in that he presented “Living The Life” on to the track with the wrong number on his horse, instead of number 9 it had number 11 .This was changed at the start.
--Mr Taumanu stated K Webber the trainer of Living the Life had presented that horse in the birdcage for race 6, with the wrong number. Driver L. Hollis was stopped and the number was changed. Mr Webber was approached following the race and given the opportunity to accept a $200 penalty to which he declined.
--Mr Webber in his defence explained that although he did not admit the charge he confirmed Mr Taumanu’s presentation to be true. However Mr Webber explained how he went to the numbers box twenty five minutes before his horse was due onto the track and there was no number 9 saddlecloth. He went back a second time and it was still not there. On the third occasion K. Webber explained it was close to time for presenting his horse on the track and asked in a raised voice for his number. A junior person gave him a number and in haste went off to put it on his horse .By this time he was under pressure, had not checked to see if his number was correct until he was requested to see Mr Taumanu after the race.
--Due to that pressure Mr Webber felt strong mitigating circumstances had a bearing in his culpability.
--Decision
--The committee after hearing the evidence presented accept there were mitigating circumstances in the delay by the club to provide the numbers as required, but as part (2) of Rule 849 states “where the trainer, horseman or person in control of each horse in the race shall ensure that the proper numbered saddle cloth is attached prior to the horse parading in the assembly area.”

Mr Webber failed in his obligation to check his saddlecloth.
The charge is Proven.
--Penalty:
Mr Taumanu confirmed Mr Webber has a clear record and stand by the recommended penalty of $200.
Mr Webber asked the committee to consider his clear record and take into account the pressure he was put under to get his number, but conceded he had erred in not checking it.
--Penalty Decision
--The committee have addressed the recommendation of a $200 penalty, and arriving at a point appropriate to the offence find Mr Webber was at fault for not checking his number, but has in his favour a clear record, and mitigating circumstances which prevented him from collecting his saddlecloth were out of his control.
--Mr Webber is fined the sum of $125.
