Facts:

Following the running of Race 10 Information No.A10251 was filed with the Judicial Committee referring to an incident that occurred during the running of Race 3 (Keith & Meryl Goss Memorial Handicap Trot). It was alleged by the Informant that Mr Martin the driver of DANKE shifted his horse outwards near the 1250m and forced WHATABOYZ (Z Butcher) to race wider on the track.

Mr Martin admitted the breach and endorsed the Information that he did not wish to be present at the hearing.

All films of the incident were shown and Mr Muirhead said that Mr Martin and DANKE were racing 4-back on the markers and that Mr Martin shifted out to follow PRIMUS INTER PARES and in doing so shifted WHATABOYZ out over extra ground. Mr Muirhead said that following that shift Mr Butcher was able to push Mr Martin back to his former position.

Submissions for Penalty:

Mr Mulcay said that Mr Martin had a clean record under the Rules. He said that the JCA starting point was for a penalty of 5 drives or a fine of $250. He submitted that a further mitigating factor was that the breach had been admitted by Mr Martin.

Reasons for Penalty:

The Committee was mindful of the JCA starting point for such a breach and taking all matters into consideration determined that a fine of $200 was an appropriate penalty.
