Charge:
Following Race 6, Graduation Horseman N Pritchard was charged under Rule 869(3)(b). The information stated: ”Graduation Horseman N Pritchard drove REAL TIDY carelessly striking the wheel of the sulky of ALTO MARIO with approx. 250m to run”.
Rule 869(3)(b) states:
“No horseman in any race shall drive:-… (b) carelessly;”
Mr Pritchard confirmed that he understood the rule and that he admitted the breach.
Facts:
Using the films, Mr Wallis identified Mr Z Butcher’s drive, ALTO MARIO in the trail and Mr Pritchard (REAL TIDY) located three back on the fence. Mr Butcher’s horse comes off the running line at the point of the home turn and REAL TIDY comes out, and in doing so, strikes the inside wheel of Mr Butcher. This caused Mr Pritchard’s horse to break stride momentarily and lose his momentum.
Mr Pritchard had nothing to add, except to say he was one stride too short and that he had thought he had cleared Mr Butcher and had enough room on Mr Butcher’s inside.
Submissions for Penalty:
Mr Wallis submitted that Mr Pritchard was a Graduation Horseman who, prior to today, had driven on four occasions. Last season he had 17 drives, and the stewards therefore would not classify him as a busy driver. In light of Mr Pritchard’s admittance of the breach and co-operation with the process, stewards submitted that they did not view this breach at the high end, and submitted a fine of $250-$300 as appropriate.
Mr Pritchard submitted that he was a Central Districts driver who had never come to the attention of the JCA. He stated his preference for a fine as he did not want to let connections down.
Reasons for Penalty:
The committee had regard to all the submissions placed before it, and noted that the JCA Penalty Guidelines indicated a starting point of a $400 fine or a 8 drive suspension. The committee placed this incident at the low level, classifying it as very minor. It also concurred with the view that Mr Pritchard initiated his movement just one stride too early in this regard. The committee gave credit for the respondent’s early admittance of the breach and his good driving record, even though he is licensed as a Graduation Horseman with limited rides during a season. The committee also considered there to be no resultant interference to any other horses as a result of this incident. The committee considered a fine as appropriate on this occasion, and imposed a fine which was in line with previous penalties for similar breaches of this rule.
