Mr. T. Taumanu asked for a ruling after viewing the film of Race 1 contending that horse 6 Meander with Earl beached Rule 870 (1) (3). Driver, P. Ferguson, was present and indicated he would represent the connections.
--Rule 870 (1) reads: “When any horse breaks from its gait in any race its horseman shall take all reasonable steps”, the breaking horse regulation goes on to say “(b) any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater shall be deemed to be in breach of rule 870 (3)”.
--The films of the finish were shown and Stipendiary Steward pointed out the markers on the running rail giving a clear indication of the distance of the breaking of the gait. He contended that rule 870 (1) (3) had been breached as Meander with Earl had clearly galloped.
--Mr. P. Ferguson, after having the rule confirmed, agreed his horse had breached the rule and agreed to its disqualification.
--The committee then confirmed the disqualification and the placings to now read:

4th 7 Arbee
5th 9 Jimmy Dream
