It was alleged that in Race 4 the earplugs on POCKET BATTLESHIP failed to activate and malfunctioned when driver, Mr DJ Butcher, pulled them.

Mr Small signed the information acknowledging a breach of the rule, however, he also indicated he did not wish to attend, but instead had horseman Mr DJ Butcher represent him.

Penalty:

Prior to making his penalty submission Mr Escott presented Mr Smalls record, which showed no previous breaches of this rule.

It was submitted by Mr Escott that the standard penalty for a breach of this rule was in the main, a fine of $200 and in this case he saw no reason why this should be departed from.

Mr Butcher, when making his submission, explained how the malfunction occurred and stated that he believed the penalty for a breach of this rule should attract a fine no greater than $100. He further stated that he was most unhappy with the levels submitted by Mr Escott. He submitted that he would be agreeable to a fine of $100.

--

The committee acknowledges that there is consistency in penalties imposed for breaches of this rule, however, the committee finds that Mr Small should be given significant credit for his clean record particularly given that he races a large number of horses.

Given all the factors it is the finding of this committee that Mr Small be fined the sum of $150.
