Following the completion of Race 4 the siren sounded instigating a protest against the provisionally place third horse DREAM ON BAILEY (driver D Butcher) alleging a breach of Rule 870 (5).

Following the completion of Race 4 the siren sounded instigating a protest against the provisionally place third horse DREAM ON BAILEY (driver D Butcher) alleging a breach of Rule 870 (5).
--Stipendiary Steward Taumanu using the available films, informed the Committee he believed that two stride prior to the winning post DREAM ON BAILEY broke and was in a gallop crossing the line. He believed that the horse’s head came up and it crossed the line in an incorrect gait.
--Mr Small told the Committee that he felt that his horse never went out of his gait. He did concur that DREAM ON BAILEY did pace roughly just short of or on the point of the line and felt none of the available films showed his horse galloping.
--In summing up Mr Escott told the Committee he felt that point of the incident was 1½ or two strides short of the post and that the horse did gallop.
--DECISION and REASON
--We have carefully considered the points of view from both parties in reaching our decision. While the available films gave a clear view at the finish and we agree that DREAM ON BAILEY did break we were not able to ascertain where the breaking of its gait did occur. Therefore the protest is dismissed.
