SUCCESSFUL WOMAN was disqualified from Race 1. The amended placings to be:

Facts:

Following the running of Race 1 (Shirley & Kevin Farrier Handicap Trot 2500m), an Information was filed with the judicial committee. It alleged a breach of Rule 870(3) and the Breaking Horse Regulations, concerning fourth placed SUCCESSFUL WOMAN, which was alleged to have failed to regain its proper gait when approaching the 50 metres mark.

The provisional placings were:

1st - (8) DANCINGWITHTHESTARS

2nd - (11) CONSENTUAL

3rd - (9) PRISCILLA P

4th - (2) SUCCESSFUL WOMAN

5th - (7) JOHN JOSEPH

6th - (3) MISTRESS CASTLETON

The Information was endorsed by the respondent as not contesting the protest.

Submissions for Decision:

Using the head on films, Mr Neal identified SUCCESSFUL WOMAN going into a gallop in the run to the winning post. The side-on film established this as occurring as she approached the final 50 metres mark. It was clear that she continued in a gallop until well after the winning post.

Reasons for Decision:

It was clear from the head-on and side-on films that SUCCESSFUL WOMAN failed to regain its proper gait, going into a gallop for a distance in excess of 50 metres during the final stages of the race. The respondent did not contest this and the committee determined it was appropriate to exercise its discretion to disqualify SUCCESSFUL WOMAN from Race 1.
