Facts:

Mr Neal sought the disqualification of BIM BOM BAY (4th) in Race 9 (The Next Meeting Saturday 17 October handicap Trot) on the ground that the horse galloped in excess of 50m in the final 200m. Mr Fleming endorsed the information stating that he did not contest the protest. Mr Fleming was not present during the hearing.

The rules and regulation provide:

870(3) any horse which breaks from its gait shall promptly regain its proper gait.

Breaking Horse Regulation (B) states:

Any horse which breaks from its gait within the final 200m of any race and continues on in the break for a distance of 50m or greater shall be deemed to be in breach of rule 870(3) in that it has failed to promptly regain its proper gait.

Section ii of the Regulation provides that the Judicial Committee may disqualify the horse from the race under Rule 1003(2).

Submissions for Decision:

Mr Muirhead showed the films and said that BIM BOM BAY broke its gait inside the final 200m and continued in a break for at least 100m. Mr Muirhead showed marker points on the video replays that confirmed the distance that the horse had been in a break.

Reasons for Decision:

The film evidence clearly showed that BIM BOM BAY had broken its gait inside the final 200m and continued in a break for in excess of 50m. Under the circumstances placed before the committee, it was determined that the horse BIM BOM BAY be disqualified.
