Facts:

After the completion of Race 1 the siren sounded indicating a protest. It was alleged that approaching the 250m mark ‘Elegant Sun’ tightened ‘Sunsoon’ for racing room causing ‘Sunsoon’ to break.

Provisional placings, as called by the judge, were
1st 12 Sweetcheeks
2nd 10 Motua Claudia Rose
3rd 11 Elegant Sun
4th 2 Monaro Mite
5th 1 Rarangi Jewel
Sunsoon it was established finished 7th. Margins Long neck - ½hd - 1¼l - 1½l

The hearing commenced at 12:27pm after a delay in assembling the participants. The decision was announced at 12:39pm.

Submissions for Decision:

Mr Renault using the available films indicated the point in the race that "Sunsoon" broke. He submitted that the actions in "Elegant Sun" moving inwards when following the eventual winner "Sweetcheeks" caused the breaking.

Mr J Abernathy (Sunsoon) was called as a witness. He informed the committee he was holding his position and it got tight. He believed contact was made. Mr. Renault submitted that "Elegant Sun" was travelling 3 wide and then moved inwards.

Mr. Munro (represented by senior horseman Mr R Jenkins) informed the committee that his drive was not travelling the greatest, there was a bit of squeezing and his horse was lugging in. He didn’t believe that contact was made, and there was no pressure from other horses.

Mr Jenkins believed the incident could be classed as a normal racing incident and the films did not conclusively show that the movement of Mr. Munro's drive caused "Sunsoon" to break.

Reasons for Decision:

The committee carefully considered the available films. The films of the incident were not of a high standard. The quality of the film was hampered by the image of a large light pylon, on the point of the turn. There is no question that "Sunsoon" broke, however, what was not clear was whether 'Elegant Sun" in its movement inwards just prior to the point of the turn caused "Sunsoon" to break. "Elegant Sun" was travelling 3 wide down the back straight, whether that inward movement, albeit slight, was enough to cause "Sunsoon" to break before the point of the turn could not be, in the committee's mind, clearly established because of the film quality. A clear gap could be seen between the two horses at the point of the turn. The committee is of the opinion that the tightening and any contact that may have been made occurred after "Sunsoon" broke. "Elegant Sun" was trotting a little roughly but the available films were insufficiently clear to indicate at what point in the race interference occurred.
