Facts:
Driver S Doody admitted a breach of rule 869(2) in that during the running of race 7 at Manawatu Harness Race meeting, The Darryl and Nic Bradley Mobile Pace, he used his whip excessively inside the final 400 metres.
Mr Doody, whilst admitting the breach also elected not to appear at the hearing.
Mr Mulcay, using the available film of the incident pointed out the excessive number of strikes of the whip during the last 400 metres. It was agreed by the committee the total number was 12.
The relevant regulation states no horseman is permitted to use their whip in a striking motion on more than 10 occasions inside the final 400 metres. This is inclusive of backhanders and the use applies to the horse, harness, and/or sulky.
Submissions for Penalty:
Mr Mulcay, using the whip regulations guidelines asked for a fine of $200 as: -
1 - It was Mr Doody's first offence
2 - It fell within the 11 to 13 sliding scale.
Reasons for Penalty:
The Committee agreed that as the breach fell within the sliding scale indicated and that it was Mr Doody's first breach of the rule a fine of $200 be imposed.
