Following the running of race 1, the Kealls Plumbing Plus Trot, K Chittenden the driver of AHOLICS BORN TO TROT, was charged with a breach of Rule 864(2)(e) It was alleged that Mr Chittenden failed to activate the removable hood on AHOLICS BORN TO TROT
Following the running of race 1, the Kealls Plumbing Plus Trot, K Chittenden the driver of AHOLICS BORN TO TROT, was charged with a breach of Rule 864(2)(e) It was alleged that Mr Chittenden failed to activate the removable hood on AHOLICS BORN TO TROT during the event.
--Mr Chittenden admitted the breach and appeared at the hearing to submit factors in mitigation of penalty.
--When making his submissions Mr Escott stated that as the horses returned to the birdcage he questioned Mr Chittenden as to why he had failed to activate the removable hood on his horse. Mr Chittenden's response was that his horse was hanging and as a consequence he was not in a position to do so.
--Mr Escott then demonstrated, by way of the films of the last 800m of the race, where he believed Mr Chittenden had opportunity to release the removable hood.
--Mr Escott then moved to penalty where he submitted that the matter be dealt with by way of a fine.
--Mr Chittenden, while acknowledging the breach, asked the committee to take into account that his horse was hanging and that, in his view, to pull the hood may have resulted in his horse breaking.
--PENALTY.
--When considering the penalty to be imposed for this breach the committee has heard from Mr Chittenden that his horse was hanging, and as such this was a contributing factor in him not activating the removable hood.
--However while it can be seen from the films that the horse was hanging on the bends, the committee nevertheless finds that ample opportunity existed in the last 800m of the race for Mr Chittenden to activate the removable hood, and as such little weight is placed on this argument.
--Therefore after carefully considering all factors, including Mr Chittenden's admission and his good record, the committee finds that the penalty to be imposed is a fine of $200.00 This being consistent with penalties for similar breaches of this rule.
