Facts:
Following the running of Race 4 (Maneline Farrier Supplies Palmerston North Mobile Pace) Information No.A10260 was filed with the Judicial Committee. It was alleged by the Informant that Mr S Abernethy drove carelessly near the 200m when his horse(IMOLA) contacted a wheel of BILL HALEY (J Abernethy) and broke briefly.
Mr S Abernethy signed the Information in that he admitted the charge and did not wish to be present at the hearing. This matter was confirmed by the Informant Mr Mulcay.
The films were shown and Mr Mulcay said that in the approach to the 200m Mr S Abernethy and his drive IMOLA were on the back of BILL HALEY racing one-off the markers. He said that at the 200m Mr Abernethy went for a run inside BILL HALEY with his horse and when shifting hit a wheel and broke up for 4 strides. He said that the sulky wheel of BILL HALEY was not punctured.
Submissions for Penalty:
Mr Mulcay said that Mr Abernethy had one prior breach of the Rule for a similar incident of hitting a wheel, that being at Oamaru on 1 December 2018 when a fine of $250 was imposed. He said that Mr Abernethy had had 143 drives since that breach. Mr Mulcay said that the JCA starting point was for a 6-drive suspension or a $300 fine. He submitted that in his opinion a fine would be in order for this breach of the Rule.
Reasons for Penalty:
The Committee determined that the breach was at the low-end of the scale and that a fine would be a suitable penalty.
