Decision:

Following Race 3 an information was lodged alleging a breach of Rule 857 (7) (9) in that Mr J H Abernethy, SPARKLE N GLITTER, failed to maintain his position behind the mobile until start point.

Following Race 3 an information was lodged alleging a breach of Rule 857 (7) (9) in that Mr J H Abernethy, SPARKLE N GLITTER, failed to maintain his position behind the mobile until start point.  The breach was not admitted.

Stipendiary Steward  Mr T Taumanu told the Committee that SPARKLE N GLITTER had drawn wide.  It was pulled back early and just sat there.  It was, he believed, pacing fluently and no effort was made to bring the horse up.

Mr Abernethy believed his horse did put in a couple of rough strides.  He was not trying to come across and went back to last.  He was concerned as his horse had galloped at the start on the first night.

DECISION & REASON

--

After viewing the available films, the Committee finds the breach proven.  There was every opportunity to push the horse and this was not done.

SUBMISSIONS ON PENALTY

--

Mr Taumanu told the Committee that this was Mr Abernethy’s first charge under this rule and asked for a fine of $250.  Mr Abernethy made no comment.

DECISION

--

In coming to our decision to impose a monetary penalty, this Committee has taken into account that this is your first breach under this rule.  While we do believe that your drive was travelling fluently there were a couple of occasions that your horse did look to pace a little rough.  We have taken this into consideration also.  You are fined the sum of $200.
