An information alleging a breach of Rule 857 (7) (g) that Mr G Martin, driver of BETTORS STAR, failed to come up into and / or maintain his position on the mobile with his horse. 



An information alleging a breach of Rule 857 (7) (g) that Mr G Martin, driver of BETTORS STAR, failed to come up into and / or maintain his position on the mobile with his horse.  The breach was not admitted.

Stipendiary Steward Mr T Taumanu, using the available films, pointed out that BETTORS STAR had not got up to the mobile.  He was 1½ lengths from the other horses and maintained that position.  The horse was not pacing roughly and was, he believed, travelling fluently.

Mr Martin told the committee his drive did not seem happy in the ground down on the inside and it was a bit scratchy.  He had no speed in the loose going.  Mr Martin thought it may have been a false start.

DECISION & REASON

--

Having viewed the films of the incident the Committee believed the rule had been breached.  There was every opportunity for BETTORS STAR to be hunted up but this did not occur.  The Committee believed the horse was pacing fluently.

SUBMISSIONS ON PENALTY

Mr Taumanu informed the Committee that this was Mr Martin’s first charge under this rule.  He read from the JCA Guide for Penalties and asked for a fine in the vicinity of $250.  Mr Martin believed a fine of that magnitude was too high.

DECISION

--

Mr Martin, in coming to our decision to impose a fine of $200, we have taken into account that this is the first charge under the rule and that the stipendiary steward the breach to be in the medium range.
