Following Race 4 an information was lodged alleging a breach of Rule 869 (2) (a) in that Mr S P Doody, TUAPEKA MARINER, used his whip in an unnecessary manner of the final stages.

The breach was not admitted.

Stipendiary Steward Mr T Taumanu told the Committee that Mr Doody struck his mount three times when well out of contention.  There was no reason to hit the horse, which broke after the third strike.  At that stage the horse was running last and it was not a good look.  Mr Doody is a professional driver and trainer, and should know his responsibilities.

Mr Doody told the Committee that he did not think it looked bad and certainly was not excessive.  The horse, he said, does not put its mind to racing.

Mr Taumanu informed Mr Doody that he also did not believe that it was an excessive use of the whip.  The charge was one of unnecessary use.

DECISION & REASON

--

The Committee, after revisiting the films, found the case proven.  Mr Doody’s drive was well out of contention when the horse was struck.  The incident did not look good.

SUBMISSIONS ON PENALTY

--

Mr Taumanu told the Committee this was Mr Doody’s first charge under the rule and indicated he thought a fine of $250 would be appropriate.

Mr Doody asked for a period of suspension instead of a fine and would be quite happy to miss day one of the Cup Carnival.

--

DECISION & PENALTY

--

The Committee has accepted and agreed for a period of suspension to be imposed for this breach.  The period of suspension will commence after the completion of racing today, 01 November and end after the completion of racing on 12 November 2009 (3 North Island days suspension).
