THE PROTEST:
--Following the running of race 8, information 30897 was filed by Licensed Jockey Ms K Myers under rule 642 (1). The information stated that “I, K Myers, allege that “Dating” or its rider placed first by the judge interfered with the chances of “Zennista” placed second by the judge. The interference occurred in the home straight”.

Rule 642 (1) states:-
--“If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”

FACTS:
--The official placings in the race were:-
--1st - 7 Dating
--2nd - 8 Zennista
--3rd - 9 Lol
--4th - 12 Waiana Gold
--5th - 10 Shrine
--6th - Savilhro

Then official margin between 1st and 2nd was half a head.

Ms Myers used the head on view of the film to show that on entering the home straight she was ahead of Mr Macdonald. She said that approximately the 100m mark she had moved out slightly and at the same time Mr McDonald had moved in sharply and made contact with her horse. She said her horse was a big filly with a large stride and the impact caused her to lose balance and momentum. She said her horse faltered and her back end went from under her when contact was made and she was put off stride She said that 60m off the post she had the race won but then lost her momentum when contact was made. She said at the point of contact she was a “good head margin” in front and Mr McDonald only got in front of her in the last 3 or 4 strides before the winning post.

Ms Latta said that Zennista was a large 16.2 hands filly and to get a bump and then be leaned on and taken off stride made it difficult for her get back up again. She said that because of the interference Ms Myers was only able to ride her out hand and heels in the final few metres to the post.

Ms Myers was asked by the Committee if she had to stop riding. She said she had to re-balance her horse and couldn’t use her stick as Mr McDonald had run into her and was leaning all over her.
----
Mr McDonald said that at approximately the 200m mark both Dating and Zennista were getting tired and his horse had moved in and Ms Myers’ horse had moved out at the same time. He did not feel the contact made by his horse made too much difference to the chances of Ms Myers’ horse. He said he felt he was being pushed on by Ms Myers for a considerable distance after the 200m mark and that, in the closing stages when both horses were being ridden hands and heels and despite his horse continuing to be leaned on by Ms Myers’ horse, he pulled away in the final few strides to win by half a head.

Ms Rogerson said that at the 250m mark Zennista was leaning in on Dating and it was Dating that was put off balance. She said the winning margin was too big to justify changing the places.

Stipendiary Steward Mr R Neal said both horses had shifted ground and that Mr McDonald had shifted in slightly more than Ms Myers had shifted out. He said once contact was made both horses were put off balance and then continued to race in close proximity to each other and towards the end of the race they were leaning in on each other as horses do when getting tired. He said the protest had merit but a significant factor was that both horses had shifted ground at the point where contact was made. He said he believed at the time contact was made Mr McDonald had a narrow lead over Ms Myers which he maintained to the line He felt he could not say that the bump suffered by Ms Myers was of such significance that it warranted a change of placings.

REASONS:
--The Committee has reviewed the films of the incident and listened carefully to the submissions of all parties. There is no doubt that contact was made as a result of Ms Myers on Zennista moving out and Mr McDonald on Dating moving in and this was not disputed by either jockey. We believe Mr McDonald was slightly ahead of Ms Myers when the contact was made. We believe the bump that both horses received was not sufficient for the committee to be wholly satisfied that, had it not occurred, Zennista would have beaten Dating and won the race. We have also noted that towards the end of the race both horses were leaning slightly in on each other and that in the final 50m of the race both were being ridden hands and heels. Finally, and importantly, we have noted that Dating was drawing away from Zennista at the finish line.

We are not convinced that, had the incidents described by Ms Myers not occurred, she would have finished ahead of Mr McDonald and accordingly the protest is dismissed.

DECISION:
--On returning to the enquiry room the parties were advised that a full written decision would be available on the JCA website as soon as possible. They were told the protest was dismissed and the placings as called by the Judge (as detailed above) were confirmed. The authorisation to pay all dividends was given.
