As the charge was admitted the charge was found to be proved.
Penalty:
Accordingly we impose a fine of $300.
Charge:
Following Race 8, the Group 1 Levin Classic, an information was lodged by the Stewards alleging a breach of Rule 638(2) in that K Myers made a celebratory gesture prior to the winning post.
Facts:
Mr Neal showed the side-on video of the final stages of the race which clearly showed Ms Myers raise her whip one to two strides short of the finish.
Submissions for Penalty:
Mr Neal told the committee Ms Myers had one previous breach of this rule in December 2011 where she was fined the sum of $100. He said on this occasion she was very close to the finish and had just been a little premature in celebrating the win. He made no particular submissions in regard to penalty except to suggest the committee took into account recent breaches.
Ms Myers had no submissions to make on penalty.
Reasons for Penalty:
In coming to a decision on penalty the committee took into account the nature of Ms Myers celebratory gesture, her record under this rule and the stake and status of the race. We considered the breach to be minor as it was immediately prior to the post and Ms Myers did not stand up and wave the whip in an extravagant manner. This was however her second charge in 12months and today’s breach occurred in a Group 1 race.
