Following the running of the Protech Roofing Levin Stakes, Mr DG Bradley, rider of the fourth placed horse STATESWOMAN, initiated a protest under rule 876(1) against the winner ARICA (C Lammas) on the grounds of interference over the last 100 metres. The margin fourth to third was a nose.

Mr Bradley used the head-on film of the finish to assert that as he began to work into a generous gap between ARICA and DEL TORO, ARICA rolled out and eventually closed the gap to the point where he stopped riding several strides short of the post. He believed the interference cost his horse more than a nose and definitely her third placing. Mr Marsh used the side-on film of the incident to support Mr Bradley's argument.

Mr Lammas acknowledged ARICA moved out but believed STATESWOMAN was not racing kindly and this as much as ARICA's movement caused her to bump DEL TORO and be tentative in taking the gap.

Ms Frost focused on Mr Bradley's ride and drew attention to the fact that as Mr Bradley stopped riding a significant gap appeared for his horse to run into over the final few metres.

Mr Furness acknowledged ARICA had moved out but asserted that STATESWOMAN had bumped DEL TORO of its own accord.

Mr George, Chief Stipendiary Steward, submitted that ARICA had moved out as a run was presented to STATESWOMAN but went on to assert that STATESWOMAN and DEL TORO were not running truly and therefore all three horses contributed to the interrupted run of STATESWOMAN. He also agreed with Ms Frost that Mr Bradley had taken hold of his mount just as a widening gap was presented to him a few strides off the post.

The Committee finds that ARICA did move out and affect STATESWOMAN's rightful running line but STATESWOMAN and DEL TORO (less significantly) were both moving about and all three horses contributed to STATESWOMAN's interrupted run. We consider that STATESWOMAN was tentative in taking the gap and that Mr Bradley eventually took hold at a point when a very generous gap opened several strides off the post. Taking these matters into account we do not consider, the narrow margin notwithstanding, that ARICA's outward movement alone so materially affected the chances of STATESWOMAN as to warrant a change of placings. The protest is therefore dismissed and the judge's placings stand.
