Following the running of Race 8, an information was lodged alleging that M.Rarere, being the rider of Jonnyhil placed 5th by the judge, failed to weigh in as required under the Rules of Racing.

Following the running of Race 8, an information was lodged alleging that M.Rarere, being the rider of Jonnyhil placed 5th by the judge, failed to weigh in as required under the Rules of Racing.

Mr Rarere admitted the breach and was represented by senior rider, Mr R.Hannam. Mr Hannam was also representing the connections of the horse who had been called over the PA system but had failed to turn up.

Jonnyhil was disqualified under Rule 856 (1).

Mr McCutcheon told the committee that it was the rider's obligation to ensure that he hears the call and weighs in, and Mr Rarere failed to do so. He said he could not consider Mr Rarere to be an inexperienced apprentice rider and therefore his riding fee should be forfeited. He also requested a monetary penalty for failing to weigh in. Mr Rarere had no previous charges under this rule. The connections of Jonnyhil lost stake money of $250.00.

Mr Hannam told the committee that although Mr Rarere has had about 70 rides he could only put this breach down to a little bit of inexperience and confusion.

Decision

In coming to a decision on penalty the committee took into account Mr Rarere's good record and his guilty plea but we could not accept that inexperience had been to blame.

He is required to forfeit his riding fee under Rule 523 (3) and for the breach of Rule 858 (1) he is fined $250.00.
