Mr Turner’s Jockey’s Licence was suspended for a period of 10 Riding Days, to commence after racing on 30 November up to and including racing on 15 December 2019.
In fixing penalty the Committee was mindful that the term of suspension included two Premier Race days.
Facts:
Following the running of Race 4 (Paul Ireland Digger Hire Premier) Information A11661 was filed with the Judicial Committee. It was alleged by the Informant that Mr D Turner failed to make the carded weight for BELLE PLAISIR.
Mr Turner acknowledged that he understood the Rule and the Charge and he confirmed to the Committee that he admitted the breach.
Submissions for Penalty:
Mr Oatham said that when Mr Turner went to weigh out for BELLE PLAISIR he was 1kg over the carded weight. He said Mr Turner then changed some gear but was still 1kg over and was replaced by Ms Myers. Mr Oatham said that Mr Turner did not have a good record having 7 previous breaches in the last 12 months with his last 3 being:
25 July--Fined $450
27 July--6 days Suspension
19 September-8 days Suspension
Mr Oatham submitted that a further period of suspension be imposed.
Mr Turner asked for a suspension and fine as there were some big meetings coming up including Group Races. Mr Turner said that he has tried to improve the weight situation by keeping in touch with trainers and that he has to get permission from Stipendiary Steward Mr Goodwin before he accepts a ride under 56kg. He asked that any suspension imposed starts after 30 November.

Mr Turner has an unenviable record under Rule 330(3)(c) with the latest breach being the eighth in the last 12 months.
Mr Turner asked for a suspension and a fine which would enable him to get back riding a little sooner. The Committee gave this request along with the admission of the breach consideration but due to the record and the habitual offending believed that a term of suspension was in order.
