Facts:
Following the running of Race 6, (Dunstan Feeds Rising Stars Championship Qualifier), Information A6997 was filed with the Judicial Committee. It alleged that Mr Prastiyou, the rider of SWINGING SKIRTS allowed his mount to shift inwards near the 100m causing interference to DARSCAPE PRINCESS (J Parkes).
Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Prastiyou in the presence of Mr Smith, said that he understood the Rule and confirmed to the committee that he admitted the breach of careless riding.
Mr Oatham had Mr McLaughlin show the film replays and Mr McLaughlin said that Mr Prastiyou and his mount were racing on the outside of the field with Mr Parkes to his inside. He said Mr Prastiyou drew the stick and his horse shifted in and placed Mr Parkes and his mount in restricted room and that Mr Parkes had to steady. He added that Mr Prastiyou was not the required distance clear and had shifted in almost 3 horse widths.
Mr Smith on behalf of Mr Prastiyou said that in the early shift that Mr Parkes’ mount shifted away from Mr Prastiyou’s horse of its own accord and that contact had not been made. He said that the only time Mr Prastiyou had been careless was over the final 3-4 strides of the shift.
Mr Prastiyou had nothing to add.
Submissions for Penalty:
Mr Oatham produced Mr Prastiyou’s record which showed that he had incurred one suspension only for careless riding in the previous 12 months, that being on 12 October 2016 when a 3 riding day suspension was imposed. Mr Oatham placed the carelessness in the low-range but added that the interference may have cost DARSCAPE PRINCESS 3rd placing as it was beaten narrowly for that position. He said that a suspension in the vicinity of 4 days would be a suitable penalty.
Mr Smith asked the committee to be mindful of Mr Prastiyou’s good record, that it was low-scale interference, that it only happened in the last 3 or so strides and he doubted if it had cost DARSCAPE PRINCESS 3rd placing.
Mr Prastiyou said that he was riding at Ellerslie on 26 November and would not be riding at Te Rapa on 27 November or New Plymouth on 1 December 2016. He had nothing further to add regarding penalty.
Reasons for Penalty:
Mr Prastiyou, by allowing his mount to shift in when not sufficiently clear, encroached the rightful running line of Mr Parkes’ mount and continued to do so which necessitated Mr Parkes having to stop riding his mount out and steady. It was observed that Mr Prastiyou did take some corrective action to straighten his mount, albeit too late. Whilst the interference was not the worst one would observe, riders should at all times exercise due care towards their fellow riders as safety is paramount. As DARSAPE PRINCESS was narrowly beaten for 3rd placing, the committee was of the opinion that with an uninterrupted run to the line, the horse would perhaps have finished in a higher placing. The committee took this matter into consideration when assessing quantum of penalty.
Using the JCA guideline of a 5-day suspension, the committee gave a discount for the admittance of the breach and good record. Under all the circumstances pertaining to penalty it was determined that a 4 riding day suspension was an appropriate penalty to impose.
