Facts:
Following Race 4 a protest was lodged pursuant to Rule 642(1).
Mrs L Allpress alleged that horse number 8 (MASIH CHIANTIK) or its rider, placed 2nd equal by the Judge, interfered with the chances of horse number 15 (PREPARED), placed 4th by the Judge. The interference occurred in the home straight.
Judges' placings were:
1st - FORGIVE NO FORGET (12)
2ND = REASONS UNKNOWN (14)
MASIH CHIANTIK (8)
4th - PREPARED (15)
The official margin between the 4th and 2nd equal was a nose.
Submissions for Decision:
Mrs Allpress played the head-on video and showed how she had a clear line of running until MASIH CHIANTIK moved outwards taking that line. In order to prevent clipping heels, she was forced to take a hold, angle outwards and make a run to the outside of that horse. Once clear she made ground strongly to get to within a nose of MASIH CHIANTIK and stated that she thought that she could have actually won the race had she been free of any interference. Mr Mathews did not have much more to add, only that the films clearly showed the interference as described by Mrs Allpress.
Mr Lammas admitted moving outwards but did not believe that he had interfered with the chances of PREPARED in the race. He said that Mrs Allpress did not have to stop riding and had plenty of galloping room to continue riding hands and heels. The only reason she had made ground at the end was because his horse was tiring. Mr Searle concurred with Mr Lammas.
For the Stewards, Mr Oatham said that in the lead-up to the incident there was movement from both horses but Mrs Allpress straightened her mount and was entitled to her line of running. Mr Lammas did move out and it was up to the committee to decide if he had been clear of Mrs Allpress when he did so. The Stewards did not believe he was clear and therefore supported the protest.
Reasons for Decision:
The committee carefully considered all of the evidence and revisited the three views of the incident. Mrs Allpress lost momentum at a crucial stage of the race and recovered to finish strongly being beaten into 2nd by the narrowest of margins. Mr Lammas admitted moving outwards and the side-on video showed that he was not clear of PREPARED when he did so. Mrs Allpress had no choice but to pull her horse back when he took her line of running. The rear-view demonstrated how off-balance Mrs Allpress became as a result of the interference. Considering the loss of momentum and the narrow nose margin at the finish, it was our opinion that had interference not occurred PREPARED would have finished ahead of MASIH CHIANTIK.
