The Committee has decided to exercise its discretion and declares “Castle Bee” to be a non-starter. Authorisation is given to the payment of amended dividends.

Facts:

Following the running of Race 9, the “New World Levin Handicap”, Information A2740 was filed by Stipendiary Steward Mr N Goodwin seeking a request for a ruling under Rule 632. The Information said “Rule 632 – Request for a Ruling as to whether “Castle Bee” was given the opportunity for a fair start”.

Rule 632 states “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter”.

Submissions for Decision:

Mr Goodwin used the head-on film of the start of the race to highlight “Castle Bee” who was drawn in barrier 10 in the 14 horse field. He asked the starter Mr Ripikoi to explain from his perspective what happened at the start.

Mr Ripikoi said he was not aware that the rider of “Castle Bee”, Mr Magorrian, was calling out to him that he was not ready. Because he did not hear any calling he gave the all clear and released the horses from the barrier. He confirmed that he was positioned on the inside of the running rail and did not see Mr Magorrian at any point prior to letting the horses jump away because the attendant who was in the stall with “Castle Bee” was blocking his view of the rider.

Mr Magorrian said when “Castle Bee” became fractious in the gates he stood on the side of the gates and asked for a Starter's Assistant to help him with this horse. He said as he was beginning to place his feet in his irons he called out in a loud voice that he was not ready but then the gates opened. In that instance he managed to jump back on the side of the gate and “Castle Bee” then raced away riderless.

Licensed Trainer Mr K Gray represented the trainers of the horse - Messrs Baker and Forsman - during the hearing and indicated he had no objections to the horse being declared a non-starter.

Mr Goodwin said it was the submission of the Stewards that “Castle Bee” be declared a non-starter.

Reasons for Decision:

The Committee carefully considered the films of the start and submissions of all parties. The Committee is satisfied “Castle Bee” was denied a fair start because the starter could not see that Mr Magorrian was not sitting on the horse with his feet in the irons when he gave the all clear and released the horses from the barriers. The Committee is satisfied Mr Magorrian did call out that he was not ready but this was not heard by Mr Ripikoi and that the incident arose because of this breakdown in communications.
