Rule 868 (1) (a) states “A horse shall not run with any of the notifiable gear set out in the seventh schedule to these rules in any race unless....(a) the horse ran with such gear at its previous start (in which case sub Rule 3 of this rule shall apply”

Mr Finnegan indicated on the information he admitted this breach of the rules. As the breach of the rule was admitted the charge was proven.

The stipendiary stewards believed that a fine of $100 was an appropriate penalty and on this occasion the Committee were satisfied this was an appropriate amount. Accordingly Mr Finnegan is fined $100.
