Decision:
Following the running of race 2, the El Cheapo Cars Dash for Cash 3YO Maiden Mr Lammas was charged with excessive use of the whip under rule 530 (2) (b). The information alleged that “B Lammas used his whip in an excessive manner on DASHING ROSIE prior to reaching the 200m”.

--Rule 530 (2) (b) states “Every rider commits a breach of these rules who, in the opinion of the Judicial Committee....strikes his horse with a whip in a manner or to an extent which is unnecessary, excessive or improper....”
--Mr Lammas, who was assisted by licensed trainer Mr P Belsham, indicated on the information he admitted this breach of the rules and he confirmed this at the hearing. He also agreed that that he understood the charge and the rule it was laid under. As the breach of the rule was admitted the charge was proven.
--Stipendiary Steward Mr Goodwin showed the film and said that after coming round the home turn into the straight Mr Lammas hit his mount 13 times without a break prior to the 200 metres mark which was well outside the guidelines for use of the whip. Mr Lammas said his horse was flat coming round the turn but when he started hitting it it started to run on and he thought at one point that he could run second. He agreed, however, that he did strike the horse too many times.
--Penalty Submission
--Mr Goodwin said Mr Lammas had not been charged previously under this rule. He submitted that his his horse was floundering in the heavy track conditions and that Mr Lammas’ use of the whip on this occasion was not acceptable and did not comply with the use of whip guidelines. He said that it might be seen that he was obtaining an advantage by using the whip in the way he did when compared to other jockeys who rode within the guidelines. He thought the offence was in the mid range and could be dealt with by a fine of between $200 and $300. Mr Lammas had no comments to make on penalty.
--Decision
--In coming to a decision on penalty the Committee considered all the submissions put before it. We have taken into account Mr Lammas’ frank admittance of the breach, the fact this is his first charge under this rule and other recent penalties imposed which range from $150 to $500. We believe on this occasion a fine of $200 is the appropriate penalty.
