Charge:
Mr Neal lodged an information alleging a breach of rule 534 (1) in that Mr Laxon failed to scratch CENTAROSE and DANELIZEE by the specified scratching time.

 

Facts:
This was a hearing opened at the Levin Racing Club meeting on Friday September 23rd but adjourned until today because Mr Laxon was not present at the races on the day.
Mr Neale told the committee that just before racing commenced at Otaki the Stewards were advised by staff at NZTR that Mr Laxon only notified the Racing Bureau at 10.15am that his two horses were scratched. The latest time for scratching a horse is at 7.30am on the morning of the races. There were horses balloted for the race and these were denied the opportunity to run due to Mr Laxon’s late notification.
Mr Laxon explained that he forgot to scratch his horses the day before and only realised his mistake when a rider engaged to ride one of the horses rang him to say that they were still entered for the race on race morning. It was only then that he rang the Racing Bureau and advised of the scratching.

 

Decision:
As Mr Laxon admitted the breach the charge was found proved.

 

Submissions for Penalty
Mr Neal said that Mr Laxon had not breached this rule before but two horses who could have gained a start did not. This affected not only the connections of the balloted horses but also the club’s turnover as a direct result of the smaller sized field. He submitted that a fine in the vicinity of $500 was appropriate.
Mr Laxon said that he had been training for over 50 years and had never made this mistake before. He explained that he was not used to racing on a Friday and had mistakenly thought the races were on Saturday. He believed he had all day Friday to scratch his horses and only realised his error when rung by one of his riders on race day.

 

Reasons for Penalty:
The committee considered all of the submissions. The aggravating factor in this situation was that two potential runners were denied the chance to take part in the race. This obviously affected both the connections of those balloted horses and the Racing Club’s turnover Mr Laxon failed in his duty as a trainer to notify the Racing Bureau by the required time of 7.30am on race day. The committee accepted that Mr Laxon made a genuine mistake. We must also give credit to Mr Laxon for his exemplary record over 50 years of training.

 

Penalty
He was fined the sum of $400.00
