The Committee’s decision is that DANDEEDEE is declared a non-starter.
Authorisation is given for the payment of amended dividends as a result of that decision.
Facts:
Following the running of Race 7 the “Paul Ireland Digger Hire Handicap”, Information A8798 was filed by Stipendiary Steward, Mr Goodwin seeking a request for a ruling under Rule 632(1). The Information requested “whether “DANDEEDEE got a fair start”.
Rule 632(1) states “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter”.

Ms Hirini, the rider of DANDEEDEE, said the horse had initially been hesitant to go into its barrier (number 10 in the 11 horse field) and when it eventually walked in she had both her legs out of the irons. She said she managed to get her right foot into the iron by the time the gate behind her had closed and was in the process of reaching down with her hand to put her left foot in the iron when the gates opened.
Mr Goodwin played the Trackside coverage of the start from behind the barriers. He said the film confirmed Ms Hirini’s description of what had happened, and it was the Stewards submission that as DANDEEDEE had not finished in the first three placings it be declared a non-starter.
Starter, Mr Ripikoi said he did not realise Ms Hirini was not ready when he pushed the button to open the gates after ascertaining that all riders were ready to go. The Trackside film does show one of the Starters Assistants standing on the ground behind Ms Hirini giving the thumbs up to Mr Ripikoi which is why the field was let go.
Ms Hirini said she did not hear the Starter call out as she was focussing on getting both her feet in the irons.
Reasons for Decision:
The Committee has considered the film of the start and the submissions of Starter and Ms Hirini. There is no doubt that Ms Hirini was in the process of using her hand to put her left foot into the iron and that her left hand was still on her foot when the start was made. As DANDEEDEE jumped Ms Hirini’s left foot came out of the iron all together with the horse losing all chance. It is to Ms Hirini’s credit she was able to get her left foot back into the iron after a few seconds and complete the race albeit some distance from the body of the field.
The Committee places no blame on the Starter who was given the “OK” signal from one of his staff positioned behind Ms Hirini even though it is clear Ms Hirini was not ready to jump.
The Committee believes that to be fair to the connections of DANDEEDEE and the betting public who invested on the horse that it should be declared a non-starter.
