Mr Tanaka indicated the breach of the rule was admitted and also that he understood the charge and the rule it was laid under. As the breach of the rule was admitted the charge was found to be proved.
Penalty:
The Committee has decided a period of suspension is appropriate. Since 01 December 2010 the JCA has adopted 5 riding days as the starting point in considering the term of suspension for careless riding charges. The Committee has taken into consideration Mr Tanaka’s excellent riding record, the fact he admitted the breach and also that Mr Walker’s horse was racing fiercely at the time. We believe the interference is at the low end but we also note that Mr Tanaka did look to inside more than once when moving across and should have realised Mr Walker was having difficulties. Mr Tanaka is suspended for 3 riding days from the close racing on Sunday 19 December 2010 to the close of racing on Monday 27 December 2010 – the 3 riding days being Matamata (22 December), Awapuni/Ellerslie (26 December) and New Plymouth/Rotorua (27 December).
Charge:
Following the running of race 2, information 5277 was filed by Stipendiary Steward Mr N Goodwin under rule 638 (1) (d). The information stated that “near the 900m M Tanaka allowed his mount “Invincible Brad” to shift in when not clear of “Lawrence of Arabia” (D Walker) causing that runner to check”.
Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”
Facts:
Mr Goodwin used the head-on view of the film to identify the two horses involved and used the head on and side on views of the film to demonstrate how the interference had occurred. He said that approximately 300m after the start Mr Tanaka was racing 5 wide, looking to his inner and moving across towards the running rail. He pointed out Mr Walker’s mount which was racing 2 off the fence and said it was racing very keenly and giving Mr Walker some difficulty. Mr Goodwin said that despite Mr Tanaka continuing to look to his inside he continued to come across and was barely a length to a length and a quarter in front of Mr Walker when he finally crossed him further aggravating the situation Mr Walker was in and causing him to have to check his horse.
Mr Tanaka said he agreed with what Mr Goodwin had said. He said he had been looking to his inside when moving across and thought he was clear of Mr Walker especially as he had not heard any calling from his inside. He said the film showed that he came across too early although he thought the other horse had “kicked up” on his inside at the moment he got in front of Mr Walker.
Submissions for Penalty:
Mr Goodwin said Mr Tanaka was a national rider and this was his first charge under this rule since 4 February 2010 and only his second in the last 14 months. He said Mr Tanaka had a very good riding record and that he was always considerate of others riders. He said Mr Walker was having difficulties with his mount but the actions of Mr Tanaka in moving across when not the required distance clear made the situation worse for Mr Walker. In his view the incident was at the low end of the scale but in looking across as he was Mr Tanaka had ample time to correct his line. He submitted that a “period of suspension towards the low end” would be appropriate.
Mr Tanaka had no comments to make on a penalty other than to remind the Committee of his very good riding record.
Reasons for Penalty:
The Committee has reviewed the films of the incident referred to and listened to all the submissions made. The head-on film clearly shows Mr Tanaka moving across from the middle of the track to take up a position closer to the running rail. In moving across he looked to his inside on more than one occasion but at the point of crossing Mr Walker he was no more than 1 to 1 and a quarter lengths clear. The committee believes Mr Tanaka should have been aware of the difficulties Mr Walker was having and made an attempt to straighten his mount but he didn’t and the result was the check to Mr Walker.
