Facts:
Mr Renault, Stipendiary Steward, alleged that Mr Williamson used his whip on more occasions than permitted in clause (b) of the Use of the Whip Regulations on his drive on TWO PLY in race 8, the GLAMOUR HOOVES RACING STABLES KUROW CUP.
Rule 869 provides as follows:
(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.
The Use of the Whip Regulations provide:
(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr Williamson indicated on the information that he admitted the breach and did not wish to be present at the hearing.
Mr Renault, stipendiary steward, demonstrated the alleged breach on the videos. He pointed out that Mr Williamson had used his whip 12 times in the last 400 metres. Mr Renault said the respondent had been spoken to a couple of times earlier in the day as he was regularly getting close to the permitted 10 strikes.

Mr Renault produced the respondent’s record. Mr Williamson had 452 drives last season, and has had 16 this season. Mr Williamson had a previous breach of this rule on 9 June last at Invercargill when he was fined $200. He has had 58 drives since that breach. Mr Renault stated Mr Williamson had indicated that he wanted the suspension to start immediately.
Reasons for Penalty:
The count for Mr Williamson is 12. He agrees that this is the number. The Penalty Guide provides a starting point of a 3 to 5 day suspension where the breach is a second or subsequent one within a six month/ 200 drive reset period. We take a 3-day starting point and there are no aggravating or mitigating factors that require an adjustment to this. It is a misjudgement by Mr Williamson who told the stipendiary stewards that he did not realise he was over the 10. We note there were distinct pauses after the 10th and 11th strikes.
