Facts:
Mr Renault, Stipendiary Steward, alleged that Mr O’Reilly used his whip on more occasions than permitted in clause (b) of the Use of the Whip Regulations on his drive FLYINGMASTERWILLIAMS in race 2, the PGG WRIGHTSON/ PICK & SHOVEL WINE PACE.
Rule 869 provides as follows:
(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.
The Use of the Whip Regulations provide:
(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr O’Reilly indicated on the information that he admitted the breach and did not wish to be present at the hearing.
Mr Renault, stipendiary steward, demonstrated the alleged breach on the videos. He pointed out that Mr O’Reilly had used his whip 11 times in the last 400 metres. There were 2 strikes, then 4 backhanders, before 5 free hand strikes to the line.

Mr Renault produced the respondent’s record. Mr O’Reilly had 190 drives last season and has had 2 this season. Mr O’Reilly had a previous breach of this rule on 15 April at Methven when he was fined $200. Mr Renault submitted a 3-day suspension was appropriate and stated that Mr O’Reilly was aware that this was the penalty that the RIU would be seeking.
Mr Renault stated that Mr O’Reilly was not seeking a deferment.
