Facts:

Miss Cameron was charged with a breach of r 869(2) and clause (b) of the Whip Regulations following race 9 SBT Marketing (2009) Ltd Junior Drivers Mobile Pace, at the Kurow TC meeting on the 18th August 2019. The Information alleged Miss Cameron…”used her whip more times than is permitted under Clause (b) of the use of the Whip Regulations, inside the final 400m.”

Rule 869 (2) reads:

No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

Whip Regulation (b) reads:

No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Miss Cameron admitted the breach and appeared at the hearing assisted by Mr Purvis.

Mr Munro, with the assistance of the video replays stated Miss Cameron (PAUL’S VERDICT) was about midfield on the outer when passing the 400m mark. She shifted wide soon after to improve her position on entering the home straight. Mr Quirk stated Miss Cameron was observed to use her whip about 12 times from the time she improved and up to the finish line.

Mr Purvis stated that Miss Cameron’s use of the whip was borderline. She had made an effort to use the whip correctly. Miss Cameron said she needed to work on her whip action. She was in the Cadet scheme and would be seeking guidance and instruction on whip use.

Submissions for Penalty:

Mr Quirk said Miss Cameron had only nine drives as a Junior Horsewoman. She had no previous charges under any rule. He sought a fine of $200 as per the scale set down in the penalty guide.

Miss Cameron made no submission as to penalty.

Reasons for Penalty:

Miss Cameron is new to the ranks of Junior Drivers. She has had nine drives from limited opportunities and has an excellent record. She acknowledged she needs to adjust her whip action and is seeking guidance for that. We take into account Miss Cameron admitted the breach, at the low end of the scale, and that she is attempting to rectify her whip use. In this instance we give Miss Cameron credit and reduce the fined from the $200 starting point.
