Decision:

Mr Hong has admitted the breach. We thus find the breach is proved.

Penalty:

Mr Hong is suspended from riding from the end of a suspension that concludes on 8 January 2019 up to and including 16 January 2019.

Facts:

Mr Davidson alleged that Mr Hong allowed his mount RED ROSE WARRIOR to shift ground inwards near the 200 metres causing ZAKYNTHOS to be checked in race 3, the Coupland’s Bakeries Handicap.

Mr Davidson confirmed that Mr Hong had viewed the videos in the presence of his employer before admitting the breach.

Mr McLaughlin, Stipendiary Steward, demonstrated on the videos that Mr Hong was racing 6 out and, when pushing his mount forwards, had allowed it to drift inwards and check Mr Chowdhoory. He stated that Mr Hong had taken hold of his mount but too late.

Mr Hong said his horse was laying in. He had tried to keep off Mr Chowdhoory, but he had reacted too late.

Mr Walsh stated that the respondent was riding hands and heels only and his horse was going up to win the race. He had not been using the whip. Mr Hong had reacted a stride too late.

Submissions for Penalty:

Mr Davidson stated that Mr Hong had only one breach of this rule in the past 12 months. This was on 23 June when the penalty was 4 days for a low end breach.

Mr Davidson stated the breach was low to mid range, and that the respondent’s record could be considered to be very good.

Mr Walsh said Mr Davidson had summed up the case well. Mr Hong was a promising apprentice and the breach was only low end.

Reasons for Penalty:

We are of the view that the breach is at the lower end of mid-range. Whilst it was not a win at all costs attitude, Mr Hong was aware his horse was drifting in as he rode it out to the finish of the race. He allowed it to shift in and only took corrective action after Mr Chowdhoory had been checked.

While Mr Hong has one breach of the careless riding rule, his record can be said to be very good, as he is a fairly busy South Island rider.
Taking a 7-day starting point for the nature of the breach, after discount for admission and record, we arrive at a 6-day suspension.
