Mr Chowdhoory admitted the charge and it is found proved.

Mr Chowdhoory is fined the sum of $400 and is reminded of his obligations under the Rules.

Facts:

Following the running of Race 5 the Stewards charged Mr K Chowdhoory with a breach of r 638(3)(c) in that he struck his mount ZAKUNDA forward of the shoulder on a number of occasions inside the final 100 metres.

Rule 638(3)(c) reads: “A Rider shall not strike a horse forward of its shoulder.”

Mr Davidson demonstrated on the video that the Respondent struck his mount five times on the neck in the final 100 metres of the race.

Mr Chowdhoory said it was not intentional and it was not until he saw the video that he realised it was forward of the shoulder.

Mr Pitman confirmed the Respondent’s comments and said Mr Chowdhoory knew he had done wrong.

Submissions for Penalty:

Mr Davidson said it was not a common charge and the Stipendiary Stewards could not find a precedent. The starting point in the JCA Penalty Guide is a fine of $500. Mr Davidson submitted a fine in the range of $300 to $500 should be imposed.

Mr Pitman emphasised that the Respondent would learn from his mistake.

Reasons for Penalty:

The starting point in the JCA Penalty Guide is a $500 fine. The only precedent the Committee could find was a $500 fine where the strike was to the head. The strikes on this occasion were to the lower neck of the horse. They did not appear to be deliberate, however animal welfare considerations are clearly evident. Mr Chowdhoory has no previous breach of this Rule and has admitted the breach.
