Decision: We find the breach proved.

Penalty:

Mr Bullard is suspended from the end of racing at Omakau on 3 January 2012, up to and including 11 January 2012. This is 3 days.

Facts:

Mr Ray, Stipendiary Steward, alleged that Mr Bullard allowed his mount, CHIEF RULER, to shift in when not clear, causing CONFUSED (C Lui), to have to be checked when passing the 100 metres.

Mr Davidson, Stipendiary Steward, demonstrated on the video, that early in the run home, CHIEF RULER had drifted off the rail, leaving a run to his inside for CONFUSED. Mr Lui had commenced to take that run, when Mr Bullard shifted back in just before the 100 metre mark. Mr Lui was ½ to ¾ of a horse length into the gap when Mr Bullard shifted in, and as a consequence, he had to check his horse.

The defendant said that he was unaware that Mr Lui was going for the run on his inside, and that there was no calling. He said that his horse was fighting out the finish with a chance of 1st or 2nd, that he had been in the lead, and was simply unaware that he had left a gap for Mr Lui on the rail.

Submissions for Penalty:

Mr Ray produced the defendant’s record, which was clear for the season, other than a 6-day suspension at Banks Peninsula. He described this record as very good. He viewed the breach as mid range, although the interference was at the lower end. He submitted a 3-day suspension was appropriate. Mr Bullard agreed with the informant’s submission.

Reasons for Penalty:

We view the breach as mid range. As a consequence of the defendant’s actions, Mr Lui clearly lost a run on the inner of CHIEF RULER, to which he was entitled in accordance with the Rules. The defendant is a very busy South Island rider who rides quite often in the Central Districts as well. In light of this, we regard his record as being excellent. Taking a starting point of 5 days, we give a one-day discount for this record, and another for the admission of the breach.

Mr Bullard originally asked that the suspension be deferred until after the meeting at Reefton. However, just after the conclusion of the meeting, he requested that the suspension start after Omakau. After hearing from both parties at Waikouaiti meeting on 1 January, we are satisfied that Mr Bullard was not trying to take advantage of the fact that Reefton has (now) been abandoned. When he requested to alter the period of his deferment, no final decision had been made with respect to this meeting. We note also that there is a meeting at Otaki on that day at which Mr Bullard could have ridden.
