An information filed by Stipendiary Steward Mr J. Muirhead against Junior Horsewoman Ms J. Compain driver of UNRELENTING alleging a breach of the above rule in that she drove her horse carelessly when she improved the horse outwards with approximately 700m to run, her horse striking the sulky of AMBOSELI driven by Mr J. Dickie causing her own horse to break and lose its chance.

Dickie causing her own horse to break and lose its chance.
--Ms Compain admitted the breach and was present at the hearing assisted by Mr M. Purdon.
--Mr Muirhead said Ms Compain improved her horse outward at about the 700m mark but the off foreleg struck the sulky wheel of AMBOSELI. UNRELENTING broke and lost its chance. Ms Compain and Mr Purdon accepted the evidence of Mr Muirhead. The video film confirmed the evidence of Mr Muirhead.
--Penalty:
--Mr Muirhead said Ms Compain had no relevant breaches of the rules recorded against her. He said the offending was mid range on the scale of seriousness. He suggested a three day suspension or a fine in the range $250.00 - $500.00. He said Ms Compain averages about one and a half drives per week. Ms Compain said she would prefer a suspension. Ms Compain and Mr Purdon accepted the submissions of Mr Muirhead. In fixing penalty the committee takes into account the following matters:
--1. The guilty plea.
2. The submissions of Mr Muirhead.
3. The acceptance of those submissions by Ms Compain and her preference for a suspension.
4. The offending was mid range on the scale of seriousness.
5. Ms Compain’s good driving record.
6. The recommended starting point for penalty is a fine of $400.00 and/or a two week suspension.
Balancing those matters, but with emphasis on the offending being mid range and the fact that Ms Compain’s horse lost its chance, the infrequency with which Ms Compain drives and Ms Compain’s good driving record, the Committee suspends Ms Compain’s horsewoman’s licence from the end of racing tonight until the end of racing on 22nd October 2009, which is effectively three days.
