Facts:
An information instigating a protest was lodged by Stipendiary Steward Mr J Muirhead which alleged that in race 2, Horse 7 All About Speed placed fourth by the judge interfered with the chances of horse 8 Harry the Maori who finished last. The interference occurred with approximately 750 metres to run.
Judges' places were:
1st 2 Easy For Cullen
2nd 4 Painted Black
3rd 3 Only Whisper
4th 7 All About Speed
5th 5 Anvil Justice
6th 6 JDs Dream
Footage of the earlier protest into the same race was accepted as relevant for this hearing. This clearly showed All About Speed to break briefly when travelling outside Easy For Cullen. In doing so All About Speed interfered with the progress of Harry The Maori immediately behind causing that horse to break losing all chance and finishing last in eighth place.
Trainer Mr D Branch confirmed to the committee that he would not contest the protest.

Mr Muirhead sought the relegation of horse 7 All About Speed to eighth place on the gounds that it had caused interference to Harry The Maori.

It was clear to the committee that All About Speed had caused interference to Harry The Maori who broke and lost all chance.
