Facts:
Following the running of race 1 Stipendiary Steward Mr J Muirhead lodged an information lodging a protest against the placing of the fourth placed horse Galleons Warrior on the grounds that it broke and galloped for approximately 300 metres from the start of the race.
The information was endorsed and signed by Mr Herlihy the trainer/driver and stated " I do not contest protest 4th placing'.
Judges' placings were:
1st 10 Gadeiros
2nd 3 Ron Burgundy
3rd 4 Clarius
4th 5 Galleons Warrior
5th 9 Classic Vance
Mr Muirhead referred the committee to video footage of the start of race 1 and identified Galleons Warrior starting from barrier 5. The horse broke at the start and galloped for approximately 300 metres before regaining a pacing gait.
Submissions for Decision:
Mr Muirhead submitted that Galleons Warrior had clearly breached the provisons of Rule 870(3) and The Breaking Horses Regulations and sought the disqualification of the horse pursuant to Rule 1003(2). Mr Herlihy was not present for the hearing but confirmed he did not contest the disqualification.
