An information was lodged by Stipendiary Steward, Mr J Muirhead, against Mr K Sefonte, trainer of OUR SUNNY WHIZ, alleging a breach of Rule 864(2)(b) in that he failed to ensure that the shoes on the horse were in good order and condition.

DECISION & REASON:

An information was lodged by Stipendiary Steward, Mr J Muirhead, against Mr K Sefonte, trainer of OUR SUNNY WHIZ, alleging a breach of Rule 864(2)(b) in that he failed to ensure that the shoes on the horse were in good order and condition.

Mr Sefonte admitted the breach and did not wish to be present at the hearing.

--

Mr Muirhead said that prior to the start of the race it was noticed that one of the horse's shoes had twisted and moved forward. The farrier was called but took some time to get to the starting point as he was otherwise engaged. Upon examination, the shoe was found to be very thin, the nail heads almost worn away and the cleats protruding out of the hoof. The start of the race was delayed for over four minutes.

Mr Muirhead said that if the problem had not been sighted, the horse's performance could well have been affected.

Penalty:

Mr Muirhead suggested a fine in the region of $200 - $500.

--

Mr Sefonte had no relevant breaches of the rules recorded against him.

--

This was a premier meeting.

--

In fixing penalty, the Committee took into account the following:

  3. No relevant breaches of the rules against Mr Sefonte
  4. --
  5. The submissions of Mr Muirhead
  6. --
  7. The stakes payable for the race - $20,000 ? this was a premier meeting.

Balancing those matters, a fine of $200 was imposed.
