FACTS

--

Stipendiary Steward Mr J MUIRHEAD lodged an information charging amateur horseman T WENN with using his whip excessively when driving CULLY’s CREATION over the concluding stages of race 4

--

Mr Wenn admitted the breach and elected not to be present for the hearing.  Accordingly the charge was established.

--

 

--

Footage of the concluding stages of the race was shown to the committee where it was established that Mr WENN struck his horse approximately 25 times in the run home without abatement. 

--

 

--

Submissions on Penalty

--

Mr TAUMANU submitted this was clearly excessive and at the higher end of offending.  Regardless of his amateur status Mr WENN  was bound by the rules and he requested a fine in the region of $200.

Mr Wenn did not make any submissions.

--

REASONS

--

Taking into account the offending was viewed as being at the higher end and clearly excessive  in referring to recommended guidelines the committee agreed a fine of $250 was appropriate.

--

In arriving at this decision the committee had consideration of Mr Wenn’s amateur status, his clear driving record and to a lesser extent his early plea of guilt.

--
