An information was filed the informant being Mr. J. M. Muirhead, Stipendiary Steward.

This information alleged a breach of the rules namely rule 869 (3) (b)” Careless Driving”, the defendant being Mr T.Cowan. 

An information was filed the informant being Mr. J. M. Muirhead, Stipendiary Steward.

This information alleged a breach of the rules namely rule 869 (3) (b)” Careless Driving”, the defendant being Mr T.Cowan.  The information alleged that Mr.Cowan drove Tennis Ball carelessly allowing his horse to drift out causing interference to Fastlane (Mr.A.Grayling) shortly after the start.

Mr.Cowan admitted the breach of the rules and was present at the hearing of this information.

Mr .Muirhead produced Mr.Cowans driving record and this showed no breaches of the rules only two warnings which were unrelated to this charge. Mr.Muirhead stated that Mr.Cowan has driven on only 21 occasions this season and was getting his driving career back on track, after being out of the industry for some time. Mr.Muirhead requested a fine in the range of $200/$500 or a suspension of two days, Mr.Muirhead wished the Judicial Committee to take note that relegation of the winner  had taken place in this instance.

Having taken into consideration the admittance of this breach of the rules by Mr.Cowan and also his clear driving record this Judicial Committee imposes a fine of $350.00 in this instance.

The Committee in setting this fine has taken note that relegation had taken place.
