The Committee ordered Miss Blakemore's licence be suspended from, after racing on the 28th February until the end of racing on the 22nd March. By eliminating the meetings Miss Blakemore is most unlikely to drive at, the net result is suspension of her licence for 3 race days.
Charge:
Junior driver Miss K Blakemore, being the driver of Delightful Chapel, drove carelessly when she moved her horse out and struck the sulky wheel of Georgia Brooke's sulky which resulted in her horse falling and Mr P G Young, the driver of Sockitsue being brought down approximately 200 metres after the start.
Facts:
An information lodged by Stipendiary Steward Mr T W Taumanu alleged that Junior Driver K Blakemore drove carelessly in race three.
Miss Blakemore appeared for the hearing supported by open horseman S Reid.
She admitted the breach.
Mr Taumanu referred to video footage of the early stages of the race and identified the relevant runners. Just shortly after the start and prior to the first bend Miss Blakemore was driving her horse Delightful Chapel near the rear of the field with driver Mr P G Young behind her on Sockitsue.
Miss Blakemore turned her horses head out and in doing do came into contact with the sulky wheel of Georgia Brooke driven by Mr M W McKendry. Delightful Chapel became unbalanced and fell throwing Miss Blakemore out of her sulky and onto the track. Mr Young following was unable to avoid this horse and went over the top of Delightful Chapel and was himself thrown from his sulky. Subsequently both horses were eliminated from the race. Neither driver suffered any serious injury and one horse had a minor shoulder abrasion.
Prior to Miss Blakemore's outward movement Mr Taumanu noted that Mr McKendry's horse immediately in front paced roughly for a stride or two.
Mr Reid had commented that in this event the normal procedure was to pull out and avoid the horse in front.
Miss Blakemore told the hearing that the horse should not have gone down like that. The horse was racing with a galloping hood for the first time and even with the contact to Mr McKendry in the normal course of events her horse should have stayed on its feet. She thought her horse had panicked.
Mr Reid said the slowing of the field ahead was a contributing factor.
Submissions for Penalty:
Mr Taumanu told the committee that the although the carelessness was relatively minor the consequential effects were quite serious with two horses being eliminated and potential for serious injury.
In view of this he sought a period of disqualification rather than a fine. Miss Blakemore was a Junior driver with a clear record who had been cooperative with the subsequent enquiry and readily admitted the breach. He assessed the breach as being in the upper range.
The starting point for a breach of this consequence was 20 drives suspension or $1,000 fine. A normal careless breach had a starting point of 8 drives or $400.
Taking into account a number of meetings which Miss Blakemore would not be attending or likely to drive at, he sought a period of suspension from the end of the days racing through to 22nd March.
On behalf of Miss Blakemore Mr Reid agreed that a period of suspension was preferable to a fine given her personal circumstances. She was very upset by the result of her driving and a little bit of time could be quite good for her. He believed the equipment being worn by Delighful Chapel may have been inappropriate and had contributed to the fall.
Miss Blakermore confirmed that she was unlikely to drive at premier nights or to travel to meetings in the central districts.
Reasons for Penalty:
In arriving at a penalty, the committee took into account the submissions made. We were particularly mindful of Miss Blakemore'sjJunior driver status, her relative inexperience and of the mitigating factors including the precipative action of Mr McKendry, Delighful Chapel's response to the contact, and the impact of equipment being in use for the first time on the horse. It was however, very fortunate that no serious injury to drivers or horses resulted. Mr Reid had able supported Miss Blakemore who had been cooperative throughout.
The imposition of a fine was considered harsh given Miss Blakemore's personal circumstances.
