An information filed by Stipendiary Steward Mr J. Muirhead against Mr K. Smith trainer of OUR FRED and ANOTHERCHRISTIAN alleging a breach of Rule 849 (2) in that he failed to attach the correct numbers on those horses when presenting them into the assembly area and on to the track.



An information filed by Stipendiary Steward Mr J. Muirhead against Mr K. Smith trainer of OUR FRED and ANOTHERCHRISTIAN alleging a breach of Rule 849 (2) in that he failed to attach the correct numbers on those horses when presenting them into the assembly area and on to the track.  Mr Smith admitted the breach and was present at the hearing.  Mr Muirhead said Mr Smith had reversed the numbers for the two horses and incorrectly attached them.  He said the horses actually got onto the track before the mistake was detected by Stipendiary Steward Mr Van Kan.  Mr Smith said he had no excuses for what had happened.

Mr Muirhead said the recommended starting point for a breach of this rule was a fine of $150.00.  In the circumstances, he recommended a fine of $250.00, suggesting the committee should take into account that the horses had actually got onto the track. Mr Smith said he thought a fine of $250.00 was a little bit high.  In fixing penalty the committee takes into account the following matters:

1. The guilty plea although this was somewhat inevitable.
2. The submissions of Mr Muirhead.
3. The submissions of Mr Smith.
4. Mr Smith has no relevant breaches of the rules recorded against him.
5. The recommended starting point.
6. There were two horses involved, and therefore an appropriate starting point would in fact be $300.00.

Balancing all of those matters, the committee imposes a fine of $250.00.
