An information lodged by Stipendiary Steward Mr J Muirhead against Mr B Lee, driver of CHRISTIAN SPIRIT, alleging a breach of Rule 869 (2)(a) ? Excessive use of the whip ? in that he used his whip excessively on his horse over the concluding stages of the race. Mr Lee admitted the breach and was present at the hearing. Mr Muirhead demonstrated the incident by use of the video film. Mr Lee hit his horse with the whip about 23 times in the home straight, 13 of the hits being continuous. Mr Lee accepted the evidence of Mr Muirhead. He said that CHRISTIAN SPIRIT was a short priced favourite and that he got stuck into him to get to the front and stopped using the whip once he got there. He said he didn?t want the horse to get beaten.

PENALTY

Mr Muirhead suggested a fine in the region $200.00 - $300.00. He said Mr Lee had no previous breaches of this particular Rule. Mr Lee accepted the submissions of Mr Muirhead. In fixing penalty I took into account the following :

  1. The guilty plea ? although this was somewhat inevitable.
  2. --
  3. No other breaches of this rule.
  4. --
  5. The submissions of Mr Muirhead and the acceptance of them by Mr Lee.
  6. --
  7. The offending was in the upper half on the scale of seriousness.
  8. --
  9. Fines of $300.00 have recently been imposed for this offence at premier meetings in Auckland.
