After Race 8 Stipendiary Steward Mr JM Muirhead instigated a protest into the first placing of Matter of Pride alleging interference with 2000 metres to run to Badlands Bute placed second by the Judge. Mr Muirhead sought relegation of Matter of Pride to behind Badlands Bute. The Judges' placings after the horses passed the finishing line were: 7 ? Matter of Pride, 8 ? Badlands Bute, 6, 2, 1 and 5.

Mr John Green (Co-trainer) and Mr BM Mangos were present on behalf of Matter of Pride. Mr Green confirmed that he represented the owners of that horse.

Mr Ray Green (Co-trainer) and Mr MW McKendry were present and represented Badlands Bute. Mr Green confirmed that he represented the owners of that horse.

Evidence was given by Stipendiary Steward Mr J Muirhead with reference to video tapes of the race. The evidence showed that Matter of Pride paced roughly, tangled and ran out slightly with 2000 metres to run. Badlands Bute following behind Matter of Pride (although not hard up behind that horse) ran outwards to avoid Matter of Pride. Mr Muirhead said that the progress of Badlands Bute was affected and bearing in mind that the margin between the two horses at the end of the race was a neck he felt that interference was sufficient to warrant a change of placings.

Mr McKendry said that the incident cost his horse a winning chance and he advised this committee that the incident cost him a neck. Mr McKendry said that as a result of the incident he had to drive his horse harder to get round although his horse then ended up in a position along the running line. Mr McKendry said that he either wanted to lead with his horse or sit parked but the incident meant that he had to drive his horse harder.

Mr Mangos pointed out that at the time of the incident there was room between his horse and Mr McKendry's horse and that the incident hadn?t prevented Mr McKendry from sitting parked if he wanted to. There was no contact between horses or sulkies. Mr Mangos pointed to the run that Badlands Bute had afterwards and suggested that the chances of Badlands Bute winning were affected by the horse that it was trailing tiring prior to the turn and the chances were not affected at all by the incident involving Matter of Pride.

After listening to the evidence and submissions we find that although Matter of Pride tangled and ran outwards with 2000 metres that there was no contact with Badlands Bute and there is considerable doubt as to whether its chances were affected.

The protest was accordingly dismissed.
